Trust.Reviews is in no way responsible for any libelous comments or reviews that could be classed as defamation.

All company names, brands and other company trademarks and the website belongs to either Trust.Reviews or third parties and can only be used for business purposes after a preceding permission from us or third parties respectively.
The website's content can not be copied and displayed anywhere else on the Internet, except as expressly permitted by us, by applicable open-source or content licenses, or by mandatory law.
Between you and Trust.Reviews, you retain any intellectual property rights that you hold in your User Content. However, by submitting, uploading or otherwise providing User Content through the website or services, you grant to Trust.Reviews and Rich Plugins SL a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, store, reproduce, adapt, modify, translate, publish, publicly perform, publicly display, distribute and create derivative works from such User Content for the purposes of operating, improving, promoting and marketing the services, as well as for displaying the content on third-party websites where the services are embedded.
You represent and warrant that you have all necessary rights and permissions to grant this licence and that the use of your User Content by Trust.Reviews and its sublicensees will not infringe the rights of any third party or violate any law.
You acknowledge that we may display advertisements, badges, labels, or other information near or within your User Content and that you are not entitled to any payment or compensation for such use.
All rights, title and interest in and to the Website, the Services and any related software, documentation, design, text, graphics, logos, trademarks and other content (excluding User Content and third-party content) are and will remain the exclusive property of Rich Plugins SL and its licensors. Nothing in these Terms grants you any ownership rights in or to the Website or Services.
Except as expressly permitted in these Terms or by applicable mandatory law, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile or otherwise attempt to extract the source code of any part of the Services or Website.
Nothing in these Terms grants you any right to use the Rich Plugins or Trust.Reviews names, trademarks, logos or domain names, except as necessary for normal use of the Services in accordance with these Terms.
You can cancel your subscription package with Trust.Reviews at any time, subject to any minimum term that may apply to your specific plan and in accordance with the cancellation process described in your account or order information.
Trust.Reviews reserve the right to display reviews written on Trust.Reviews if a client should cancel subscription.
We may change the pricing, features and structure of plans from time to time. Changes to pricing will not apply retroactively to periods that have already been paid, but may take effect upon renewal of your subscription. Where required by law, we will provide reasonable notice of such changes.
The Services may integrate with or display content from third-party platforms and services, such as Google, Facebook, Yelp or other providers. Trust.Reviews and Rich Plugins SL are not affiliated with, endorsed or sponsored by these platforms and your use of such third-party services is governed by their respective terms and policies.
When you connect a third-party service (for example, a Google Business Profile or a Facebook Page) via their APIs, you authorise Trust.Reviews and Rich Plugins SL to access, store and display the data necessary to perform the requested functionality, such as reviews, ratings, photos and basic business information. You may revoke this access at any time using the tools provided by the relevant third party or within your account, but this may limit or disable certain features of the Services.
We do not control and are not responsible for any third-party content, availability, functionality, pricing or terms, or for any changes made by such platforms, and we shall not be liable for any impact such changes may have on the Services.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
If you have problems using the Services or your subscription, we will be happy to provide a full refund within 30 days of the original purchase. After 30 days, no refunds will be given. Before a refund will be granted, you must allow us to try and help solve any problem you have by contacting our support team using the contact options provided on the Website. NOTE: refunds will not be granted if you simply decide not to use the purchased Services. We stand behind our Services and will assist you in solving any problem you have, but we also expect you to adequately understand what you are purchasing and why. Nothing in this section affects any statutory rights you may have as a consumer under applicable law.
Clients shall indemnify Trust.Reviews and Rich Plugins SL, as well as their directors, officers, employees, contractors and agents, against any loss or damage suffered or incurred as a result of any third party claim (including any claim or allegation by any governmental authority) that:
Client shall not bring any claim against Trust.Reviews arising from or related to any User Content, including without limitation, any claim that the User Content is defamatory, offensive or otherwise harmful.
Client shall indemnify Trust.Reviews against any loss or damage suffered or incurred by Trust.Reviews as a result of any such claim, whether such claim is brought by Client, any of Client's affiliates, or any of its or their officers, directors, employees, contractors, agents, shareholders, or other associated third parties.
The website and services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the website or services will be uninterrupted, error-free, secure, or free from harmful components, or that any content will be accurate or reliable.
Neither party excludes any loss in respect of personal injury or death, fraudulent misrepresentation or any other loss that may not be lawfully excluded or limited.
Neither party shall be liable for any loss of profits or revenues, loss of business opportunity, loss of goodwill or reputation, loss of data or any indirect, consequential or special loss whatsoever.
In particular, to the maximum extent permitted by applicable law, Trust.Reviews and Rich Plugins SL shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website or Services; (ii) any conduct or content of any user or third party; (iii) any content obtained from the Website or Services; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
To the maximum extent permitted by applicable law, the total aggregate liability of Trust.Reviews and Rich Plugins SL arising out of or in connection with the website, services or these terms, whether in contract, tort (including negligence) or otherwise, shall be limited to the amount actually paid by you to us for the services during the twelve (12) months immediately preceding the event giving rise to the claim.
To protect your information, our credit card processing vendor uses current Secure Socket Layer (SSL) or equivalent technology for secure transactions.
Our vendor is certified as compliant with card association security initiatives, such as programs operated by major card brands and payment providers.
Trust.Reviews accounts require a username and password to log in. You must keep your username and password secure, and never disclose it to a third party.
Because the information in your Distribution Lists is so sensitive, account passwords are encrypted, which means we cannot see your passwords.
We cannot resend forgotten passwords either. We can only reset them.
In connection with the use of the services, we collect user data when users register with Trust.Reviews.
This data will not be passed to a third party without prior consent, except where required or permitted by law, or where necessary for the operation of the services (for example, hosting providers, payment processors, or email delivery services acting as our processors).
To ensure that users get the best possible experience from using the website, we process information about search behavior and other user behavior on the website, including the total number of visits to the website.
The information will, however, not be processed in a way that can trace the behavior to specific users, unless such processing is required for security, fraud prevention, billing, or legal compliance. These statistical and non-personal information can be transferred to third parties.
Cookies are used on the website to monitor what parts of the website the user's browser has previously visited and enables us to adjust the website's content accordingly.
However, we do not process information gathered by cookies in this manner in a way that connects the user behavior with specific users, unless required for login, security, billing, or consent-based functionalities.
Our processing of personal data is carried out according to applicable data protection laws, including where applicable the EU General Data Protection Regulation (GDPR).
Registered users can contact us if they request information about what data are processed about them or if they wish to have the information deleted or rectified, subject to legal retention requirements.
Furthermore, registered users can at any time withdraw their consent, which can happen by contacting support@trust.reviews.
Withdrawal of consent will be considered as a request to be deleted as a registered user altogether, where consent is the legal basis for processing.
We have initiated a number of technical and organisational measures to ensure that personal information that is being processed is protected against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data transmitted, stored or otherwise processed.
Client agrees to comply with its obligations under EU Data Protection Directives and/or the EU General Data Protection Regulation as a data controller and any other legislation and/or binding regulations implementing or made pursuant to them ("Data Protection Requirements").
When enabling the Review Collection Services the Client is – in accordance with the Data Protection Requirements – regarded as a data controller of the Consumers' personal data, which is provided to Trust.Reviews when Client uses the Review Collection Services, and Trust.Reviews is regarded as the data processor.
This entails that Trust.Reviews shall only act upon documented instructions from Client in regards to the provided personal data about the Consumers. It is the sole responsibility of Client to provide such instructions to Trust.Reviews and to ensure that it has an appropriate legal basis for the processing.
Trust.Reviews shall make the necessary security measures to comply with the obligations of a data processor, including ensuring that the information is not (i) accidentally or unlawfully destroyed, (ii) lost, altered or damaged, (iii) disclosed to or accessed by any unauthorised person, (iv) misused or (v) otherwise treated in violation of the Data Protection Requirements.
On Client's request, Trust.Reviews will, in line with and to the extent provided for in the Data Protection Requirements, supply Client with sufficient information for Client to assure that the above-mentioned technical and organisational security measures have been implemented.
All data collected and processed about Consumers after they sign up on Trust.Reviews website as users are processed by Trust.Reviews as a data controller.
Trust.Reviews is not responsible for and assumes no liability for the Consumers' conduct on or use of the Trust.Reviews Service, including the content published by the Consumers (such content, "User Content"). Trust.Reviews does not and cannot control or monitor the User Content and Trust.Reviews does not endorse any User Content, nor do the opinions expressed in the User Content represent the opinions of Trust.Reviews, its affiliates, or any of its or their officers, directors, employees, contractors or shareholders.
The Agreement shall not be regarded as Trust.Reviews's approval, endorsement or recommendation of Client, Client's products or services. Client may not market itself or otherwise give public declarations in conflict with the above.
Client's use of the Trust.Reviews Service must at all times comply with all applicable laws, rules and regulations. Client warrants to Trust.Reviews that its use of the Trust.Reviews Service will in no way cause Trust.Reviews to violate any applicable laws, rules or regulations or to violate the privacy rights of any third party.
When the Client signs up for an account, a password to the account is created. This password may only be used by and for Client. Client is responsible for all use of the Trust.Reviews Service occurring under Client's account.
The rights (including all intellectual property rights) in any material, information, notifications, reviews, photos or other types of user generated content (UGC) created on the Website by Reviewers is licensed to Trust.Reviews for its non-exclusive use.
The Reviewer is not entitled to royalty payments or any other compensation or fee related to such content.
We may, but are not obliged to, monitor, edit, remove or refuse to display any User Content at our sole discretion, for example where we believe it violates these terms, our policies, or applicable law, or may harm us, other users or third parties.
If you believe that any content available on or through the website or services infringes your intellectual property rights or other rights, you may notify us by email at support@trust.reviews with sufficient detail, including:
Upon receiving a valid notice, we will review it and may remove or disable access to the content in question at our discretion, without being obliged to do so in all cases and without accepting liability.
Trust.Reviews does not produce or publish contributions on the website. Trust.Reviews cannot be held accountable for the reviews and comments made on the website. If you would like to remove or discuss an issue with the website, please email support@trust.reviews.
Trust.Reviews accepts no responsibility for the accuracy or completeness of contributions published by registered users on the website, including contributions which, for technical, external or any other cause, may be changed or deleted in connection with the publication on the website or thereafter.
Trust.Reviews does not routinely review or pre-moderate all contributions added to the website by registered users, and cannot be held responsible for the content of these contributions. However, as described in these Terms, we may in our sole discretion remove or refuse to display certain contributions.
Should the contributions contain links to third parties, Trust.Reviews will accept no responsibility for the contents of the link in question.
Trust.Reviews recommendations and reference to concrete companies, e-shops etc. is only guiding and Trust.Reviews can in no way be held responsible if the guiding recommendation turns out to be incorrect, misleading or similar.
Trust.Reviews can in no case be made to compensate for use of the website or code, including loss of revenue, working loss, market interruptions, loss of goodwill or similar losses. Furthermore, Trust.Reviews can not be made to pay compensation or similar as a result of errors or downtime, except to the limited extent set out in the section "Limitation of liability" above.
Trust.Reviews reserves the right to revise these terms at any time, as well as the right to close the website as a result of its own assessment and without warning.
We reserve the right to delete reviews that are solicited externally or that we reasonably believe to be fake, paid, or otherwise manipulated.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rich Plugins SL regarding your use of the Website and the Services, and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter hereof.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
These terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law rules.
You agree that the courts of Alicante, Spain shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms or their subject matter or formation, without prejudice to any mandatory rights you may have as a consumer under applicable law to bring claims in your country of residence.
